Terms of Use

1. Who we are and what these terms cover

The website mahjonggame.hk (the “Website”) is operated by Benjamin Schubert, a sole proprietor based in Switzerland, trading as “Hong Kong Mahjong” (“we”, “us”, “our”). When you use the Website or buy something on it, your contract is with us.

By accessing or continuing to use the Website you agree to these Terms. If you do not agree, please do not use the Website.

Our iOS and Android apps are distributed through the Apple App Store and Google Play. Purchases made inside those apps are processed by Apple or Google under their own terms, and their refunds are handled by Apple or Google. Section 7 of these Terms applies only to purchases made on the Website.

2. Your account

You must be at least 13 years old, or the minimum age for consenting to online services in your country if that is higher.
Give accurate information when you register and keep your login details confidential. You are responsible for activity under your account.
One account per person. Accounts are personal and may not be sold or transferred.
You can delete your account at any time from the app or by contacting us.

3. The game

Hong Kong Mahjong is a free-to-play game of skill. There is no real-money wagering. Points, scores, rankings, badges, tournament standings and any “payout” figures shown in the game or in our calculators are for scoring and entertainment only. They have no monetary value and cannot be bought, sold or exchanged for money or prizes.

4. Acceptable use

You agree not to:

use the Website for any unlawful purpose or in breach of these Terms;
commit fraud, send spam, or impersonate any person;
cheat, for example with bots, automation, collusion with other players, or by exploiting bugs, especially in ranked games and tournaments;
infringe our or anyone else’s intellectual property rights;
interfere with the security or operation of the Website, including uploading malware, probing or scanning for vulnerabilities, overloading the service, or scraping content or data by automated means;
harass, abuse or threaten other players, or post unlawful or offensive content in usernames, feedback or community ideas.

5. Content you submit

You keep ownership of the feedback, community ideas and other content you submit. You grant us a non-exclusive, worldwide, royalty-free licence to use, display, adapt and publish it in order to operate and improve the game. We may moderate or remove submitted content at our discretion.

6. Intellectual property

We own the Website, the game, its software, design and content, including the premium tile designs, or we license them from their owners. These Terms do not transfer any of those rights to you. The standard tile set is based on artwork licensed under CC BY-SA 4.0. That artwork stays under its licence; see Tile Credits.

7. Purchases on the Website

7.1 Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Your purchase is also subject to Paddle’s Buyer Terms.

7.2 What you can buy

We offer optional digital items, such as premium tile sets, for a one-time payment. There are no subscriptions on the Website and nothing renews automatically. A purchase gives you a personal, non-transferable, non-commercial licence to use the item in the game for as long as we operate it. Purchases do not affect gameplay or scoring.

7.3 Your account and your devices

You need to be signed in to buy on the Website. Your purchase is linked to your account, and the item is available on the Website and in our iOS and Android apps when you sign in with the same account. If you delete your account, you lose access to items linked to it.

7.4 Prices, taxes and payment

Prices are shown before you pay. Paddle calculates and collects any applicable sales tax or VAT and processes your payment. We never receive your full payment card details.

7.5 Delivery

Digital items are unlocked in your account as soon as your payment is confirmed. Usually this is immediate. If an item has not appeared after a few minutes, sign out and back in, or contact us.

7.6 Refunds

You can request a refund within 14 days of purchase. See our Refund Policy. If a purchase is refunded or charged back, the item is removed from your account.

8. Availability of the service

We work hard to keep the game running well, but we do not guarantee that the Website will be uninterrupted, error-free or always available. We may change, add or remove features, or carry out maintenance, at any time.

9. Suspension and termination

We may suspend or close your account, or restrict your access to the Website, if:

you materially breach these Terms;
a payment is not made or is charged back;
this is needed to protect the Website or other players from a security or fraud risk;
you repeatedly or seriously violate these Terms.

Where reasonable, we will tell you why.

10. Liability

The Website is provided “as is”. To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of data or profits, arising from your use of the Website. Nothing in these Terms limits liability that cannot be limited by law, or any rights you have under the mandatory consumer protection laws of your country.

11. Changes to these Terms

We may update these Terms from time to time. The date at the top shows the latest version. If you continue to use the Website after a change, you accept the updated Terms. Changes do not affect purchases you have already completed.

12. Governing law

These Terms are governed by Swiss law. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence, and you may bring claims in the courts there.
